未向农民工提供工资清单、扣押或者变相扣押用于支付工资的社会保障卡或者银行卡等违法行为，由人力资源社会保障行政部门责令限期改正；逾期不改正的，在对单位给予罚款的同时，对法定代表人或者主要负责人、直接负责的主管人员和其他直接责任人员给予罚款。
